Texas Adds to Confusion Regarding Annuity Suitability Training Reciprocity

Annuity Suitability Training: State-to-State Reciprocity Becoming an Even Bigger Issue

The Texas Department of Insurance (DOI) recently posted a list of the states with which it will be reciprocal regarding the one-time 4-hour annuity training course. According to this list, the Texas DOI will only accept training courses approved in states which they deem to be NAIC compliant. These states include AK, CO, CT, IA, IL, IN, KY, MD, ND, OH, OK, OR, RI, SC, WA, WI, WV, and the District of Columbia. Of the states that have passed NAIC model regulation, this list leaves out California, Hawaii, Nebraska, New York, South Dakota, and Utah. Texas is the first state to decide which states have an annuity suitability training requirement that is substantially similar to their own.

When passing these regulations, most states include the provision that they will accept a course taken in a state with a “substantially similar training requirement.” However, as more states pass NAIC model regulations, the reciprocity of a given course among multiple states becomes more complex, making choosing the correct 4 hr. Annuity course difficult for producers. California, for instance, will not accept a course completed to meet another state’s requirement, and states such as Utah and New York do not require a 4-hour annuity training course, meaning that their training requirement is not substantially similar to any state that requires the 4-hour annuity course.
